TERMS OF SALE

These terms apply to every purchase on maksymgladysh.com: MaxSignal, MaxPowerGrade, MaxGrab and any product added later. Free downloads (such as MaxRound) follow the same terms where they make sense, without the payment parts.
1. Who sells to you
GLADVISUAL, LLC, a limited liability company registered in New Mexico, USA, Entity ID 0008007396, with its address at 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, USA, run by Maksym Gladysh ("we", "Max"). 2. What you buy
All our products are digital and delivered online:
- MaxSignal: a plugin (.drfx) for DaVinci Resolve Studio.
- MaxPowerGrade: a PowerGrade (.drx) for DaVinci Resolve, a video course of about 2 hours, example footage and a completion certificate. The certificate is our own; it is not an official or accredited qualification.
- MaxGrab: a plugin for DaVinci Resolve Studio and an app that works next to any editor, for Mac (Apple Silicon and Intel) and Windows.
What each product does, what it does not do and what it needs (Resolve version, Studio or free, operating system) is on its product page. Please check the requirements before you buy. Your use of each product is covered by its License Agreement, which you accept when you buy, download or install it.
3. Price and payment
Prices are shown on the product page in euros, as a one-time payment. There are no subscriptions and no automatic renewals. Prices include VAT where VAT applies to your country. If you buy for a business, you can enter your VAT or tax number at checkout.
Payment is processed by Stripe through our shop provider MailerLite. We never see or store your card details.
A launch or promotional price is shown with the date it ends. When it ends, the price goes to the price stated on the page.
4. Delivery
Right after payment you see a download button on the page and you receive an email with your download link (and, for MaxPowerGrade, your course access) at the address you entered at checkout. If it does not arrive within an hour, check your spam folder, then write to us and we send it again.
5. Your right of withdrawal (EU, EEA and UK buyers)
When you buy online you normally have 14 days to change your mind. For digital content delivered right away, this right ends once delivery starts, but only if you agreed to that.
At checkout you tick a box to confirm that you want immediate access and you understand that you lose your 14-day right of withdrawal once your download link or course access is sent to you. We confirm this again in your purchase email.
This does not touch our refund promise in section 6 or your legal rights in section 7.
6. Our 7-day guarantee
If a product does not work on your computer and we cannot fix it together within 7 days of your purchase, write to max@maksymgladysh.com and we refund you in full. Tell us your computer, your DaVinci Resolve version and what happens. The full rules are in our Refund Policy.
7. Your legal rights
If a product does not match its description or does not work as promised, you have the rights the law gives you for faulty digital content (in Spain, the consumer protection law; in the EU, Directive 2019/770): we fix it, and if we cannot, you get a price reduction or your money back. Nothing in these terms takes those rights away.
8. Updates and access
Updates are free for as long as we publish them and are announced by email. Course access lasts for as long as we offer the course, and for at least 2 years from your purchase. If we ever close a course, we give you a way to download its videos first.
9. Your responsibility
Our products are tools for your own work. You use them on footage and media you have the right to use, and you respect the rights of creators and the terms of the websites and services you use them with. This matters most for MaxGrab: see its License Agreement, section 3.
10. Liability
We are responsible for the product doing what its page says. Beyond that, our liability is limited as set out in the License Agreement, as far as the law allows. Nothing limits liability for our fraud, gross negligence, or death or injury we cause, or any right a consumer cannot give up.
11. Trademarks
DaVinci Resolve is a trademark of Blackmagic Design Pty. Ltd. We are not affiliated with or endorsed by Blackmagic Design, Adobe, Apple or any website our tools work with.
12. Law and disputes
These terms are governed by Spanish law. If you are a consumer, you keep every protection the law of your own country gives you, and you can go to the courts where you live. Please write to us first: most problems are solved by email within a day or two.
13. Changes
We may update these terms for future purchases. The version that applies to you is the one on the site on the day you bought.
